Job Summary
AECOM`s Design and Consulting Services operating segment`s Canada Region is
currently looking to hire a Project Counsel to specialize in alternative
delivery legal issues- change management- and contract negotiations to sit in
one of our offices in Canada. As Project Counsel assigned to a number of our
high-profile design-build projects- this position will have the opportunity to
work on a variety of exciting and complex legal issues. The Project Counsel
will assist AECOM project managers in providing practical and sound legal
advice related to issues that arise during the day-to-day execution of these
major projects- including those related to claims- contract interpretation
and interactions with our clients- constructor partners- and subcontractors
This position requires a full understanding of the complex risk-transfe
structure on design-build projects- particularly from the perspective of
lead engineering firm that is acting as the engineer-of-record to a
constructor as a subconsultant.
Major Responsibilities:
Gain a deep understanding of the key project contracts (prime contract- design subcontract- major subcontracts- and purchase orders). This includes- among other things- acquiring familiarity with: (i) notice procedures and deadlines in these agreements; (ii) contractual risk allocation; (iii) invoicing and payment provisions; (iv) contractual remedies and preconditions to obtaining relief; and (v) dispute escalation and resolution sequence.
Provide advice to project management team on the contractual impact of proposed actions.
Provide training to the project team on key project contract provisions and compliance requirements- including notice and change management.
Drafting project correspondence to be sent to key stakeholders- including the constructor.
Reviewing and managing contract change orders/processes and ensuring that they comply with agreed-upon scope- schedule- and contract terms.
Support the project management team in creating the necessary awareness in all key personnel at the Project so that issues which may require contractual response are identified and communicated in a timely fashion.
Disseminate good practices with regards to internal communications (internal memos- e-mails between team members). Ensure good practices to that effect are followed.
Advise in the identification and preparation of claims in close coordination with project management team.
Management of project-related disputes and claims with AECOM`s in-house legal team.
Coordinate with AECOM in-house and Project outside counsel as needed.
Open and transparent communications with and functional reporting to AECOM DCS Americas legal leadership and willingness to take direction.
Periodic travel to project sites and to participate in project meetings.
Minimum Requirements
Bachelor`s degree and Juris Doctorate (or equivalent) required.
3 – 5 years of law firm or in-house experience with experience in contracts and negotiation is a must.
Construction (or civil design for construction) experience required- preferably in-house- at a construction law firm- or within a dedicated construction practice group.
Admitted to the Bar (license to practice law) required- preferably in Ontario.
Proficiency with Microsoft Office Suite- Word- Excel- and Outlook is required.
Team player with strong communication skills- attention to detail- reporting skills- analytical skills- negotiating skills and organizational capabilities.
Ability to work well under pressure.
Familiarity with contract documents- contract law.
Preferred Qualifications
The following is an asset:
Experience working in non-legal role in AEC industry prior to law school.
Technical background/undergraduate degree in civil engineering.
Proficiency in written/verbal French
